GENERAL TERMS AND CONDITIONS OF SALE – AUTOMEC S.R.L.

1. SCOPE
These General Terms and Conditions of Sale (hereinafter the “Terms”) govern the sale of products and services through the website www.gruppoautomec.it by AUTOMEC S.r.l., with registered office at Via Giuseppe Cosenza, 129 – 80053 Castellammare di Stabia (NA), Italy, VAT No. IT05297340654, e-mail info@gruppoautomec.it (hereinafter also the “Seller”).
These Terms apply both to Consumers, meaning natural persons acting for purposes outside their trade, business or profession, and to Business Customers, within the limits set by applicable law.
Any exceptions or special conditions are valid only if agreed in writing. Placing an order constitutes full acceptance of these Terms.
2. PARTIES
Seller: AUTOMEC S.r.l., as identified above.
Customer: the person or entity purchasing the products and services available on www.gruppoautomec.it.
3. PRODUCTS AND AVAILABILITY
The main characteristics of the products are described in the relevant product pages. Images are for illustrative purposes only and may not exactly represent the actual product.
AUTOMEC S.r.l. reserves the right to change prices, technical specifications and product availability at any time.
If a product becomes unavailable after the order has been placed, the Customer will be promptly informed and may choose between a refund, a replacement or a store voucher.
4. PRICES AND PAYMENT METHODS
All prices are in Euro (€) and include VAT, unless otherwise stated.
Shipping costs are calculated and shown when the order is placed.
Accepted payment methods:
- Credit/debit card (Visa, Mastercard, American Express)
- PayPal
- Bank transfer
- Cash on delivery (where available)
- Payment and collection in store
All electronic transactions are processed through secure SSL protocols. Payment details are not stored by AUTOMEC S.r.l.
Orders will not be processed until payment has been received.
5. SHIPPING AND DELIVERY
Goods are delivered by trusted couriers to the address provided by the Customer.
Average delivery time is 24–72 working hours from order confirmation, except in cases of force majeure or events beyond the Seller’s control.
The Customer must check that the package is intact upon delivery. If there is visible damage, the Customer must accept the delivery with reservation or refuse it, and notify info@gruppoautomec.it within 48 hours.
The risk of loss or damage passes to the Customer upon physical delivery of the goods.
6. RIGHT OF WITHDRAWAL
Consumer Customers have the right to withdraw from the contract within 14 days of delivery, without giving any reason.
To exercise the right of withdrawal, the Customer must:
- send a written notice to info@gruppoautomec.it within 14 days, or use the dedicated button in the footer of every page of the website;
- return the products, undamaged and in their original packaging, within 14 days of the withdrawal notice, to the following address:

The direct costs of returning the goods are borne by the Customer. If the Customer chose a delivery method other than the least expensive standard delivery offered by the Seller, the additional costs will not be refunded.
The refund will be made within 14 days of receipt of the goods or of proof of shipment, using the same payment method used for the purchase.
AUTOMEC S.r.l. may withhold the refund until the goods have actually been received.
The following are excluded from the right of withdrawal:
- customised or made-to-measure products;
- sealed products that have been unsealed after delivery;
- services that have already been fully performed.
7. LEGAL GUARANTEE AND SUPPORT
All products sold by AUTOMEC S.r.l. are covered by the legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code.
The guarantee period is:
- 24 months for Consumers;
- 12 months for Business Customers.
To claim under the guarantee, the Customer must keep proof of purchase and report the defect within 2 months of discovering it.
If a product does not conform, the Customer is entitled to repair, replacement, a price reduction or termination of the contract.

8. LIMITATION OF LIABILITY
AUTOMEC S.r.l. shall not be liable for indirect or consequential damage, or loss of profit, arising from improper use of the products or from delays due to force majeure.
In any event, the maximum liability of AUTOMEC S.r.l. is limited to the value of the order from which the damage arose.
9. PERSONAL DATA PROTECTION
Personal data provided by the Customer will be processed in accordance with EU Regulation 2016/679 (GDPR) and applicable national law.

10. GOVERNING LAW AND JURISDICTION
These Terms are governed by Italian law.
For Consumers, the competent court is that of the Consumer’s place of residence or domicile.
For Business Customers, the Court of Torre Annunziata (NA), Italy, has exclusive jurisdiction.
